The fears that Spanish people have when renting a house of their property are mainly related to late payment and the possible damage to the property. Another worry of Spanish landlords/landladies is squatting and the limits to rent level. However, the greatest concerns are the tenant´s non-payment and the misuse of the house. This is what consultancies of the real estate sector have recently shown. In point of fact, we are not talking about anything new, as these two issues have always been a headache for the Spanish owner who decides to rent his/her property. Both situations, the non-payment and the damage to the house are a double problem for the owners: on the one hand, the financial loss that this implies and also the emotional strain of dealing with these types of situations. We must take into account that if the owner makes a legal attempt there is usually not a quick legal resolution and the process of law will probably last for months ( sometimes even more than one year )and, in addition, involving uncertainty to those that endure this situation. Unlike other countries that have laws that deal with these problems, as for instance in the Netherlands, in Spain we do not have laws that rule these issues on a quick and effective way. This is the reason why, on the part of the owner, there exists a feeling of helplessness when having to face these situations.

MEASURES OF COURSE, YET WITH COMPENSATIONS

Owners are aware of the fact that the future law on housing (always in the horizon and always hanging by a thread given the difficulties in reaching agreements that could push through this law) could be a turning point for renting in Spain. According to the latest work carried out by different consulting firms (in all, 800 small owners were interviewed), six out of ten owners expressed unease with a possible State intervention regarding renting. Furthermore, 60% of the owners of rented property believe that if the State takes action on the matter by means of limiting rental prices or by carrying out anti-eviction measures, then the rental market would suffer and the housing offer would drop. This does not mean that the owners refuse to accept any type of State intervention, but they want to get in return, for accepting the measures, compensations. Nearly 70% of the owners advocate for receiving tax incentives, and 75% of them are in favour of accelerating the expulsion of the tenants in the event of breach of contract (naturally, provided that the court has previously passed sentence). Furthermore, 73% of them advocate for being able to consult the history of defaults of the tenant before renting the property.

OWNERS GIVE AN OPINION

It is interesting to know that according to many interviews, 62% of the owners stated that the prices of rental housing are high and even very high. Likewise, 78% of them think that if the notice of eviction, in the event of non-payment, was reduced then this would help lowering the prices of rental housing. On the other hand, 68% of the owners are against the Decree-Law 37/2020 which cancels the eviction proceedings during the state of alarm. In addition, 62% of the owners believe that the two-month guarantee, currently taken over by the tenant, is insufficient. Furthermore, 57% of them think that it is not enough to update annually the rent with the consumer prices index, CPI, and lastly, 80% of them state that the owners should have more tax incentives.
